A family in California has filed a lawsuit against Walt Disney World, alleging that the nacho cheese served at one of its restaurants was so hot it scalded their 4-year-old son.

The incident happened last March at the Florida theme park. The family’s lawyer says they filed the suit only after failing to resolve the issue out of court.

From the San Diego Union-Tribune:

The accident occurred when [the boy] sat down to dinner in an unsteady chair and grabbed the table to prevent himself from falling…. The boy’s hand caught the food tray and a paper cup of nacho cheese flew into his face.

The boy suffered burns to his upper lip and other spots on his face, according to the lawsuit.

The lawsuit alleges that Disney made no effort “to regulate and monitor the temperature of the nacho cheese which was being served to young children.”

“The cheese should not have been that hot,” said the family’s attorney. “Nobody has a reasonable expectation that it be served at a temperature causing immediate and severe burns on contact.”

Says a Disney World rep: “It’s unfortunate when any child is injured. We just received notice of the lawsuit and are currently reviewing it.”
