Microsoft To Apple: You Can't Trademark "App Store"

It’s been over two years since Apple first submitted an application to trademark the phrase “App Store,” but that hasn’t stopped Microsoft from attempting to stymie the iPhone maker’s request.

Microsoft’s general counsel tells BBC News it has asked the U.S. Patent and Trademark Office to reject Apple application for a trademark because the phrase is too generic:

An ‘app store’ is an ‘app store’… Like ‘shoe store’ or ‘toy store’, it is a generic term that is commonly used by companies, governments and individuals that offer apps.

The term ‘app store’ should continue to be available for use by all without fear of reprisal by Apple.

What do you think? Should other companies be allowed to use the term “app store” or has that phrase become associated exclusively with Apple?
