Also, Empire is in NY State.  The NY State Attorney General's office website posts the Consumer Law Help Manual at <a href="http://www.consumer.state.ny.us/clahm/start.htm">http://www.consumer.state.ny.us/clahm/start.htm</a> and if you check under "Contracts" you'll see a list of contract cancellation laws.  Specifically: "Telephone Sales Contracts.[17] <a href="http://www.consumer.state.ny.us/clahm/clahm-contracts.htm#17#17">http://www.consumer.state.ny.us/clahm/clahm-contracts.htm#...</a>  Consumer has three days to cancel the contract."  So the fact that they told Joanie that she couldn't cancel the contract was a false statement and they should have told her that.  She can file a complaint with the NYS Atty General's Office if necessary, but she probably won't have to.  Once she files a dispute claim with the credit card company they will likely credit her account within 2 days.  It could take 90 days to resolve the dispute with Empire but I think the law is on Joanie's side.</p>
