If I, a private citizen were to shove someone to the ground so hard for being touched on the shoulder, I would be serving jailtime for domestic violence, Aggravated assault. If, as you say, he was off duty, he should be charged as a citizen. if he brandished his weapon, or performed these actions as "an officer" then I would consider that unauthorized use of privilege. he should spend time in jail, should be dishonorably discharged, and have to wear a large hat that says: "I'm a violent man"."
