The DMCA implements a process of notification and take-down that is supposed to encourage the reduction of harm prior to the involvement of the courts. There is no "requirement" to send a notice, but if your behavior does indeed show a pattern of having allowed harm to occur such that you might have greater leverage to litigate, the judge is going to hold that against you.
