Forgot to mention--you can only withhold an amount of payment up to the cost of the damage. Common sense stuff, but I figured I'd add it, just for the sake of completeness.

You could hold the payment as "setoff" from the damage that occurred until it is fixed, however the company can still send you to collections, and you'd have to dispute that with the three reporting services. The alternative is to pay them, and file a claim in small claims court. It all depends on whether you have the patience to deal with the risks of dealing with the credit reporting agencies, if the company decides to take that avenue.

Also, there are sometimes fees associated with online or over-the-phone payments. Paying by checks eliminates those fees.

This is a trick question. You don't tip at coffee shops! If their job requires them to stay entirely behind the counter, (i.e. they don't come out and serve you while you're at a table), they've done nothing to warrant a gratuity. Making a drink correctly? That's their JOB.

Keep in mind that the Ninth Amendment is only valid against the federal government itself. The Fourteenth Amendment imposes the majority of the protections offered by the Bill of Rights upon the states; however, the Ninth Amendment is not one of them. Even if the Ninth Amendment would be applicable in this situation, it would not be able to be used against state governments.
