When A Tree Falls, Who Pays?

There’s lots of trees down after Irene and someone has to got to pay to get rid of them. But who? What if your tree fell on your neighbor’s house? What if their tree fell on your house? Who’s responsible? Here are the general rules of thumb.

CBS Philly says it’s like this:

Your tree, your house: your insurance pays to remove the tree and for the damage to your home.

Your tree, neighbor’s house: neighbor’s insurance pays.

Neighbor’s tree, your house: your insurance pays.

Your tree, falls in the yard, doesn’t hit anything: you pay out of pocket for the removal.

Lots of trees fell in lots of neighborhood forests, making lots of sounds, and lots of insurance companies will be hearing it for the next several months.
