Had LASIK with TLC, left eye in December, right eye last week. Paid for Intralase. When I did the left eye, they did the Intralase. When I did the right eye, they did micrkeratome, without telling me. Clear informed consent failure, even if the outcome was ok (left is now 20/15, right is 20/20). Clearly it’s too late to go back and make them do it right. Should I be asking for full refund, 50% refund (just for right eye), or cost differential?
I’d raise some very well-worded, articulate hell, and ask the right person what he or she would do in your situation (usually a very good tactic). A little legalese couldn’t hurt, either.
I’d ask for a refund of the cost of the procedure for the right eye. If you chose Intralase over microkeratome because of a significant reason, you should get your money back. The results, even if they are favorable, don’t change the fact that you didn’t get what you paid for…this is especially if microkeratome cost far, far less than Intralase.
I’m not sure what the differential is – most places online seem to suggest $300-450.
The trouble is, this is where I put my money where my mouth is. I’m a strong believer in tort reform (one of the reasons I refuse to join the Maryland State Bar Assoc), and need to figure out where my principles would lead me, rather than where my gut wants to go. Gut says full refund. Principles are debating the cost differential (or differential plus a slap) or full refund of surgeon fee (right eye minus TLC administrative and post-op provider) or full refund (would the money come from surgeon or facility is the issue).
They didn’t guarantee 20/20 vision? Get what you agreed to. Demand it be fixed. And check with another dioctor to be sure that different treatments won’t produce different long-term result.
Yes, it’s possible, depending on state laws. Some states would allow a tenant to agree to certain telecommunications as part of a contract, such as phone or internet. I believe my state has a specific law against it.
Ahhh, lease contracts. Usually there’s a lot in there that isn’t exactly legal, but most tenants can’t afford to fight it. Apartment people always act like they’re doing you a big favor by allowing you to pay them for some space.
Check your lease, see what you signed. But also, see what you can negotiate. Good luck.
I’ve had my beagle for a little over a week now. I’m totally in love, and overwhelmed with how to be a good doggy mama. He keeps nipping at himself, even after a bath (wasn’t that eventful). He’s a year old- anyone got any words of wisdom?
It’s a few particular spots, and one that gets a lot of nipping. I don’t know what to do. He’s eating the best, bathed him- next up is Benadryl per the vet’s instructions and medicated shampoo.
Adorable puppy! And an excellent blog. My wife is a civilian with the NAVY and has several friends whose spouses are deployed. I’ll mention this to her to pass along.
First things first make sure the food you are feeding him is meatbased, and not grain based. Everything you buy at walmart/publix is complete junk. Something like Natural Choice is a good decent priced food available at all pet supply stores, and it meat first. Most dog foods say “chicken” but if you look at the ingredients the first ingredient is usually corn.
It can take a month to make a difference. If you just adopted him I would be concerned that maybe he was being fed one of the grain-based foods. Alpo, gravy train, blah blah blah all crap
Thanks so much. I’m feeding him Merrick, which is all natural and no corn. I think the canned wet food is better than what I eat! I will be patient. That helped.
My 6 year old beagle has skin issues. They are all 100% cleared up now, but we figured out thru process of elimination that he has a corn allergy. So might want to make sure whatever you feed him has no corn in it. Also we use a medicated shampoo on him.
As others have said, sounds like food. My basset/beagle mix gets itchy if we stray too far from Blue Buffalo (expensive, I know), but she also does really well on Beneful.
My cats care not whether I am near the blanket, under the blanket, or across the room from the blanket. Yesterday Alfred waited until I was in the kitchen, and got the blanket ALL TO HIMSELF. Then, when I came back to get under the blanket, he threw a fit. He would not move, like a 3 year old, and kept meowing with a protesting sound. I finnally lifted him enough to squeeze my legs under, and then he ran away and pouted.
….A few minutes later.. he came back to me and the blanket. I guess he decided being cold wasn’t worth the tantrum.
Understood. The kids have me so tired this week, I’ve given up on making anything of three day weekends. Even my only semi-planned activity, sleeping, never happens.
Had an endoscopy on Monday (bleah!) and was told I had a hiatal hernia. I called my doctor’s office on Tuesday and they hadn’t gotten the report from the gastroenterologist yet. I’m waiting now for them to tell me what the hell I’m supposed to do. Is it huge? Do I need surgery? Do I just have to live with this terrible, random pain that strikes when I least expect it? I can’t pay for another surgery. I’ve not paid all the gallbladder one yet.
Consignment item sold and I’m still waiting for the money. The dealer has had some health problems also. Hopefully he will get better soon. He’s a really nice guy. Also, I want my money so I can buy a plane ticket to see mah honey. We are planning for the President’s Day weekend because he will probably get that Monday off. I will miss the geek convention, but I really need to see him and get out of here for a few days.
used a treatment cost estimator on BCBS to see what kinds of price ranges you might be looking at. used my zipcode as the basis so it may vary more for you
Diaphragmatic hernia, w/o surgery $145.00- $1,367.00
Diaphragmatic hernia, w/ surgery $13,539.00 – $22,038.00
Yack!!! I guess it would be better to not have surgery, unless it becomes strangulated. I’m pretty sure I would know if that happens. I have insurance, but you know they don’t like to pay diddly.
What fries my butt is that NO ONE has bothered to explain this to me. All I got was a Moon Pie and a handout. I didn’t even see the specialist after I woke up and my doctor’s office hasn’t called me yet. I hate today’s health care.
Yes, the snack. I made the cab driver stop at Backyard Burgers and I got a bunch of food and went home, stuffed my face and fell asleep. I saved the Moon Pie for my lunch and enjoyed it thoroughly.
I’m dying to see Friendboy. Although he offered to come up here so I didn’t miss the geek con (AWWW!), I feel the need to get the hell out of here for a few days. And I want him to see me in HIS habitat so the seed for my continued presence is planted, heh heh.
i made you a present

Heh. My quotes are most of the squares.
you, theblackdog and a few of mine. but yes, you covered it pretty well.
LOVE IT.
That cat’s whiskers are pretty long. Time for a shave!
You can’t see them through his double chin!
“Whoop! Whoop! Pull over, that cat is too fat!”
Not sure how to feel –

A voluntary bar? Lucky devil. Both of mine are mandatory. And $500+/year.

I don’t think you’re guaranteed 20/20 vision with laser surgery, though.
Is it legal for my apartment complex to make (800kbps down) internet service part of my rent without me being able to opt out of such a poor service?
depends on local laws i think? there should be a state tenants rights association with a list of stuff like that

No doggie wisdom here, but please post beagle pictures : )
I hope I don’t regret this, but here is a picture I posted on my Army-wife life blog:
http://unlikelywife.blogspot.com/2011/01/thank-you-and-scooter.html
The blog has absolutely nothing to do with consumerism, except for my posts about the horror of the TSA pat-downs.
Awww, thank you. He is just as addorable as I imagined! I want to rub his widdle belly : )
Does he seem to be nipping at anything in paticular? Or could he just be bored? Does he have chew toys?
It’s a few particular spots, and one that gets a lot of nipping. I don’t know what to do. He’s eating the best, bathed him- next up is Benadryl per the vet’s instructions and medicated shampoo.
Aww, what a cute goggie! I love beagles. Snoopy dogs.
awww, thanks for sharing

Why thank you, kind sir/madam!
Yeah, I second that request — we can haz pictures pleez?

Smug kitteh is too good to take your ghetto reservation.
WOOOOHOOOOOOOO FRIDAY!
I am bored, and I’m afraid I’m becoming a very boring person. I have a 3 day weekend thanks to MLK, and I have no plans whatsoever.
But I do have new super cute kitteh pictures to offer you: http://www.flickr.com/photos/kimaroo/5349794725/
i see your snuggling kittehs and raise you fat cat in a blanket
http://www.flickr.com/photos/catastrophegirl/5351721879/
I have done highly scientific analysis of both of our submitted photographs and have decided that kittehs love blue stripey blankets.
You can’t argue with SCIENCE!
I have done highly personal analyses of both these pictures and have come to the conclusion that they are FREAKING ADORABLE.
i have additional data points – as you can see, the actual preference is for the location of the blanket – if it’s on or near me, that’s what they prefer. although there is a WOOL mexican blanket on the floor in the corner of my dining room that they sleep on when i am not around. sorry, no photos

Aww…that doesn’t look like a fat kitty. But super-cute.
clearly you need additional information for the value of ‘fat’

O.M.G. Tiny head, bi-i-i-i-g giant ball of floof body!
Understood. The kids have me so tired this week, I’ve given up on making anything of three day weekends. Even my only semi-planned activity, sleeping, never happens.
I feel like that cat is judging me. And I’m not measuring up to its standards.
WEEEKENNNND!!!

Also, I hope you feel better soon however that works out. I think the weekend with Friendboy can’t come soon enough!

Holy crap, m’dear! You deserve a weekend with your sweetie. My fingers are crossed for you.
Thank ya! I’m looking forward to it!
Wait, it’s Friday? I’ve been hunkered down for ages now. Too much to do. Stress Cadet is stressing!
PS, Happy weekend everybody.
You too, ArcanaJ! XD
Anyone notice they took down the post about nominating them for the bloggies?
