Peanut distributor refuses to recall peanuts On March 23rd the FDA advised consumers to dispose of any peanut or peanut containing products made or distributed by Westco or Westcott that they find in their homes. That same day it requested a formal recall of all Westco and Westcott products containing peanuts from PCA, and a few days later it requested access to some of its distribution records, but Westco refused to cooperate. Professionally, I could not blame them for refusing. Most food service companies ride on the ragged edge of losing their shirts if they run into major trouble like this.

But personally, I'd take a pair of pliers and start crushing some nuts (if you know what I mean). The company dropped the ball with lack of QOS and maintaining high levels of standards.

Go to 93-97 Coit Street, Irvington NJ in Google Street view and tell me if buying food from this place looks like a real good deal. I'd be afraid to buy car parts from a place that looks like this. Sheesh...

This may not be the most obvious example, but it's amazing what people are willing to let companies and agencies get away with now in the United States. Look at a country with less comfortable people, or even the US 60+ years ago and people just don't normally put up with a company or person being this irresponsible.

Yeah, well I fired off an angry "I hope you go bankrupt and you likely will" email to Westco yesterday. Their website offers this email address: email@irvington-nj.com

Naturally, I've not heard back from them.

Is there not a chance that the FDA is over-reacting in this case? Why can't the company take their own liability risks and make their own decision over whether a recall is justified?

I'm not sure there's any reason to trust the FDA over a peanut company.

@zarex42: Because the company has a strong motive (profit!) not to recall and eat the cost of thousands of dollars worth of product. The FDA, on the other hand, is tasked with keeping the food supply safe.

There's a Gene Hackman movie where his character explains how car companies weigh the cost of lawsuits against the cost of fixing a deadly problem. Similar speech by Tyler Durden too. That's the economical, but not the moral, thing to do.
